For those who don't this is the story, sometime last week quite by accident whilst browsing on E-bay for pretty things I found a listing that was selling these garlands by to my shock & horror they were actually using this photo, taken by me in my home to sell them!
I was furious as I'm sure you would be too!
I contacted them & explained that the photo was mine & could they remove it from their listing & told them that I would be informing E-bay.
I didn't hear back from them for a while but eventually did they asked if they could borrow it, then could they pay for it, then would I do them a photo as they are so busy moving at the moment!!!
I couldn't believe it! Unfortunately I'm busy too but that doesn't give me license to take photos from the Internet

Anyhoo, I informed E-bay & only received an automated e-mail! Nice!
This went on for days all the while my photo still being used on the E-bay listing & them selling garlands from it!
*Growl*
Then,
then ~ get this people,
then when I was checking the listing yet again to see if it had been removed I found another listing using the same photo!!!
The
SAME PHOTO! I was furious & upset to say the least!

I contacted the second 'stealer' in the same way & got a response pretty quickly which basically asked
'if I had copyright to it & that photo on the Internet are out their in the public domain' ~ I couldn't believe it!
Really do people nowadays honestly think that they can just take any image just because it is on the Internet to pass as their own! I was completely flabbergasted!
I thought it was a well know fact that as soon as a photo is created, copyright belongs to the person who took that photo whether a copyright is stated or whether the image is watermarked or not! It doesn't matter! Obviously copyright is better to be stated to make it obvious which is done on the Vintage Amethyst website, blog & all my Flickr pages ~ which incidentally this photo is from!
I must admit many people take my photos to use on their websites etc, but I don't mind if they ask or link back to me etc. But using a photo to make a profit from because they didn't have a nice photo to use is just plain wrong in my opinion ~ especially when I sell the same product too!!!

They both claimed to have found it on Google, yes & that's because Flickr pages show up on Google as most photos on websites do, but if you click on the photo it takes you to that specific page which is where the copyright is stated!!!

Anyhoo, so I had to report this second E-bayer to E-bay with only an automated response again, so I kept complaining (I have no idea how long it takes E-bay to respond to matters!!!) then on Sunday morning finally heard from E-bay with help. They sent me some forms to fill in & fax back to them which I did!
Then today one of listings has removed the photo but I am still waiting for the second to be removed, but fingers crossed it won't be long now!

I am furious that people thought that they could take another persons photo to sell a product!
I also decided that I would be watermarking, with a copyright my photos from now on, here on the blog & on Flickr so that hopefully people will certainly think twice about 'taking' the photos to sell products! This is something I never wanted to do but after this last week I think it is the only sensible choice. I have been using every spare moment I have updated my photos on Flickr & adding a watermark, it's a big job but I'm doing it!

Fingers crossed this second photo will be removed from the lising very soon.
I must admit to being very disappointed in E-bay & the people concerned as this could very easily have been all sorted quickly especially with integrity from the E-bayers involved even after they both admitted it wasn't their photo & they had found it on the Internet, but no it's been drawn out & still hasn't come to a full conclusion ...
